Agreement You the consignee, and we, Clearwater Creek Outfitters dba Rustic Interiors, hereafter (us/we) agree that your order is an offer to purchase the products listed in your order on the terms and conditions listed below which will become a contract when accepted by us via confirmation that specifically references your order or when we ship to you the Products you ordered, whichever occurs earlier, and the banking, negotiation or other use of any payment shall not constitute an acceptance by us. When you send your order to purchase Products to us that order shall constitute your agreement to these Special Circumstances, terms and conditions of purchase. You represent you have the legal authority to enter into this Agreement on behalf of yourself or any party you represent. This Agreement may not be altered, supplemented, or amended by the use of any other document(s). Any such attempt will be null and void unless otherwise agreed to in a written agreement signed by both you and us. Order Policy Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. us/we reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verification or information before accepting any order. Your telephone call requesting placement of your order by phone will also be subject to these same terms and conditions. Prior to our check-out, you will be required review our Terms and Conditions. Production/shipping times shown are averages, not exact, you may opt out of our Best Price shipping offer in leu of faster delivery times at your expense. Your order may be picked-up from our store in Rogers or our warehouse in Eden Prairie, MN. Production times stated are approximate. Product demand varies during different seasons of the year, dictating actual production times, Times stated are approximate and can vary. Delivery times will vary by your location. Cancellations are accepted in person or by E-Mail ONLY. This provides you and us a verifiable form of cancellation. If you wish to cancel within the first 72 hours, email us using CANCEL ORDER in the message header and we will reply with an acknowledgement. Phone cancellations are not accepted. Cancellations will be accepted for 72 hours. After 72 hours our standard refund policy will apply. 5. Refund Policy Special Circumstances exist for many of our products as they are custom made special for you, and as a result custom built furniture and cabinet sales are final. No refunds, remakes, or post shipment changes are available. Box and off the shelf items are subject to 25% restocking fees and the loss of all discounts including any shipping we paid. Under no circumstances are shipping fees refunded. If an order cannot be delivered due to actions on your part, you agree to pay all shipping costs we incur. You, the consignee are responsible for properly repackaging, insuring and returning the item to our dock in Eden Prairie, Minnesota. Approved returns will have instructions and written authorization emailed to the same email address used when the order is placed. 6. Payment Terms We accept all major credit cards mentioned on the product ordering screens as the payment options for your purchase, as well as Paypal. Orders under $1500 are charged 100% to the credit card you provide at the time of your order, for custom items and any order over $1500, a 50% non-refundable deposit is owed when you place your order and the balance when it ships. 7. Guarantee Any defects in material or workmanship will be promptly rectified, provided claims are made and defective parts are return shipped within 10 days of receipt of goods for our timely examination. Other than assisting with shipping damage claims (see Shipping Damage Claims below) and manufacturer warranties, no additional warranties, expressed or implied, are provided by us. |
